Terms & Conditions

§ 1 Scope

(1) These General Terms and Conditions (hereinafter "GTC") apply to all orders placed through the NOCTPRINTS online shop, operated by Panagiotis Vakirtzis (hereinafter "Provider").

(2) The GTC valid at the time of the order apply. Deviating conditions of the customer are not recognized unless the Provider expressly agrees to their validity.

(3) The contract language is German.

§ 2 Contract Formation

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place orders (invitatio ad offerendum).

(2) By clicking the order button, you place a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation by email.

§ 3 Prices and Payment

(1) All stated prices are final prices and include the applicable VAT. Additional delivery and shipping costs are shown separately. Shipping within the EU is free of charge.

(2) Payment is processed via the payment service provider Stripe. We accept credit cards (Visa, Mastercard), Apple Pay, Google Pay, and other payment methods supported by Stripe.

(3) Payment of the purchase price is due immediately upon placing the order.

§ 4 Delivery

(1) Delivery is made to the delivery address specified by the customer within the EU. Shipping to non-EU countries is currently not available.

(2) The delivery time is usually 2–5 business days. Deviations are possible and will be communicated during the order process if applicable.

(3) Products are manufactured and shipped via our print partner Gelato locally in the customer's country or the nearest production facility.

§ 5 Right of Withdrawal

Exclusion of the Right of Withdrawal for Personalized Goods

(1) As each product is individually made to your personal specifications (personalized poster with individual texts, dates, designs), the right of withdrawal is excluded pursuant to § 312g (2) No. 1 BGB (German Civil Code). The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

(2) You will be expressly informed about the exclusion of the right of withdrawal before completing your order.

(3) In case of printing errors, shipping damage, or significant quality defects, we will of course replace your product free of charge. Please contact us at info@noctprints.com with a photo of the defect.

§ 6 Retention of Title

The delivered goods remain the property of the Provider until full payment has been made.

§ 7 Warranty

(1) Statutory warranty rights apply. The warranty period is two years from receipt of the goods.

(2) Please note that slight color deviations between the screen display and the printed product may occur. This is inherent to the printing process and does not constitute a defect.

§ 8 Liability

(1) The Provider is liable without limitation for intent and gross negligence.

(2) For slight negligence, the Provider is only liable in case of violation of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable, typical contractual damage.

(3) The above limitations of liability do not apply to injuries to life, body, or health, or within the scope of guarantees.

§ 9 Copyright

(1) The customer ensures that the texts and content entered by them do not infringe any third-party rights.

(2) The designs, templates, and appearance of NOCTPRINTS products are protected by copyright and may not be reproduced without the consent of the Provider.

§ 10 Data Protection

Information on the processing of your personal data can be found in our privacy policy.

§ 11 Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

§ 12 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.

(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
